The State Bar Board of Governors is conducting the annual performance evaluations of State Bar Executive Director Judy Johnson and Chief Trial Counsel Mike Nisperos Jr. The board is seeking comments on the performance of these two officials from interested State Bar constituencies.

The identity of all commentators will be maintained in confidence.

New rule 3-100

The new rule addresses Assembly Bill 1101, which amends the statutory duty of attorney-client confidentiality to permit disclosure of information if the attorney reasonably believes disclosure is necessary to prevent a criminal act that is likely to result in death or bodily harm to an individual.

Proposed revisions to Rule 9, "Forgiveness of Debt," of the Rules Governing Financial Assistance Plan of the Lawyer Assistance Program (LAP) would modify the types of public or charitable service that the oversight committee of the LAP would consider in waiving and forgiving any amount due and payable to the plan.

The Committee of Bar Examiners proposes increasing the passing score required for the Multistate Professional Responsibility Examination from a scaled score of 79 to a scaled score of 100, out of a maximum scaled score of 150.

Applicants for admission who can demonstrate their religious beliefs require the observance of a religious holiday on a date that conflicts with the bar exam may receive accommodation from the Committee of Bar Examiners.
