Ethics opinion

Proposed ethics opinion considers whether an attorney is ethically obligated, upon termination of employment, to release to a client the electronic version of a variety of documents. The opinion interprets California Rule of Professional Conduct 3-700(D) and Business and Professions Code §6068(e)(1).

Proposed Formal Opinion Interim No. 05-0003 considers whether an attorney may, consistent with ethical obligations, 1) deposit a client’s will or other testamentary documents with a private will depository, without the client’s consent, or 2) register a client’s will or other testamentary documents with a private will registry, without the client’s consent.
