Ethics opinion

Proposed ethics opinion considers whether an attorney is ethically obligated, upon termination of employment, to release to a client the electronic version of a variety of documents. The opinion interprets California Rule of Professional Conduct 3-700(D) and Business and Professions Code §6068(e)(1).

Proposed Formal Opinion Interim No. 05-0003 considers whether an attorney may, consistent with ethical obligations, 1) deposit a client’s will or other testamentary documents with a private will depository, without the client’s consent, or 2) register a client’s will or other testamentary documents with a private will registry, without the client’s consent.

Law school registration

Proposed new rules will regulate the registration of unaccredited, correspondence and distance learning law schools. Legislation passed in 2006 placed oversight of those schools under the Committee of Bar Examiners.
