Accommodations for bar exam

Add rule XVII to the Rules Regulating Admission to Practice Law in California, which would establish procedures for the filing and processing of petitions for testing accommodations from applicants with disabilities to take examinations administered by the Committee of Bar Examiners.

Avoiding defective filings

Amend rule 1112 of Rules of Practice of State Bar Court to (1) limit effect to hearing department documents (proposed new rule 1303 would apply to the review department); (2) correct errors; (3) add enforcement provision (reject filing) for failure to comply with existing requirements of Rules of Procedure of the State Bar, Rules of Practice of the State Bar Court, or provisions of the State Bar Act; (4) require signatures in ink; and (5) clarify number of copies required. Proposed new rule 1303 is based on existing rule 1112, but specifically drafted for the Review Department’s needs.

Change in proof of service

Proposed amendment to rule 1111, Rules of Practice of State Bar Court, would add enforcement provisions (reject filing) to existing rules which already require the filing of: (1) proof of service of a Notice of Disciplinary Charges within 10 days of filing (rule 1111(a)); and (2) designation of counsel form when counsel, rather than the respondent, is served (rules 60(b) and 61(b), Rules of Procedure of the State Bar).
