Right to arbitration

Proposed revisions to the notice of client's right to arbitration form would make four changes.

Proposed Formal Interim Opinion No. 05-0009 considers the ethical propriety of an attorney accepting credit card payments from a client for the payment of: 1) earned fees; 2) fees not yet earned; or 3) advances for costs and expenses.

Further public comment sought to consider part of a proposed revised minimum standard to delete the requirement that the client sign a request form for mandatory fee arbitration initiated by a third party guarantor.

Resignation from the bar

Proposed new rule 323 of the Rules of Procedure will delegate to the State Bar Court review department the board of governors' authority to recommend to the Supreme Court whether to accept a member's resignation. The rule also will give the Office of the Chief Trial Counsel the opportunity to present evidence relevant to the recommendation.

Proposed Public Comment

Board meetings, records

Proposed revision to the Rules Governing Open Meetings, Closed Sessions and Records of the Board of Governors would allow meeting notices and agendas to be e-mailed and would permit electronic polling of the board.
