Fee arbitration changes

Guidelines and Minimum Standards would be amended to require fee arbitration programs who mediate these disputes to (1) require the parties to enter into an agreement to mediate, and (2) provide the parties with a notice of the right to enforce the agreement. It also recommends approval of an agreement to mediate in a notice of rights after mediation.

Rule for advanced fees

Proposed new rule 4-110 (Advance Payment of Fees for Legal Services) of the California Rules of Professional Conduct and conforming amendments to rules 3-700 (Termination of Employment) and 4-100 (Preserving Identity of Funds and Property of a Client) of the California Rules of Professional Conduct.
