State Bar to appeal ruling which strikes down MCLE

A committee charged with reviewing the State Bar's Judicial Nominees Evaluation Commission has given JNE a vote of confidence, but in a draft report is recommending several changes to the process of rating candidates for the bench.

STORY FOLLOWS ...
The State Bar will appeal a lower court ruling [Warden v. State Bar] that the bar's minimum continuing legal education program is unconstitutional. At its meeting last month, the Board of Governors agreed to petition the state Supreme Court for review of the decision.

Diane Yu State Bar General Counsel Diane Yu said the board decided to appeal "because the MCLE program is an important component of the bar's public protection mission."

Malpractice insurance to get more scrutiny

The issue of legal malpractice insurance deserves more scrutiny, says the State Bar Board of Governors, but proposed legislation to eliminate a physician liability cap for certain medical malpractice claims deserves support.

At its March meeting in San Francisco, after it heard testimony regarding the complexity of the matter, board members decided to delegate the task of examining malpractice insurance for attorneys to several committees. Continued ...
