Revision to MCLE rules
Under the current MCLE Rules and Regulations,
members are required to complete at least one hour of continuing
education in the area of prevention, detection and treatment of
substance abuse and emotional distress (with a cap of six hours for
the emotional distress component). The proposed amendment will
eliminate entirely the emotional distress component from the
requirement. As a result, prevention, detection and treatment of
emotional distress will no longer be considered a required topic and
no general MCLE credit may be earned for education in that area.

Confidential proceedings
Proposed amendment to Rule 21 of the Rules of
Procedure of the State Bar of California further limits those
proceedings that are confidential only to moral character proceedings
and those where a member is placed on inactive status due to mental or
physical incapacity.

Professional conduct rules
The State Bar has reactivated its Commission for
the Revision of the Rules of Professional Conduct of the State Bar,
which has been directed to conduct a comprehensive review of the rules
and to recommend amendments. To begin its study, the commission is
seeking written comment about what amendments warrant consideration
and study, including suggestions for new rules and rule deletions, and
identifying existing rules that do not need to be changed. The rules
are online at www.calbar.org.
